Terms of Use

1. What We Are (and What We're Not)

Swapito is an online listing and matching platform that allows users to list, browse, and arrange swaps of collectible items (including but not limited to Ooshies, trading cards, stickers, and similar collectible toys) with other users.

We are not:

• A party to any trade, swap, or exchange arranged between users
• A verifier of the authenticity, condition, value, or rarity of any item listed
• An escrow service, payment processor for goods, or guarantor of any transaction
• Responsible for arranging, supervising, or being present at any in-person meetup or exchange

All trades are arranged and completed directly between users, at their own risk.

2. Account Sign-Up

Creating a trading account is free. There is no sign-up fee, no subscription, and no charge to list, browse, message, or swap on the Platform.

You must provide accurate information when creating your account, including a valid contact method.

Accounts are intended for use by an adult (parent/guardian) on behalf of themselves or their family. By creating an account, you confirm you are 18 years or older and legally able to agree to these Terms.

One account per household/user unless otherwise stated.

3. User Conduct & Trading Accountability

By using Swapito, you agree to:

• Only list items you genuinely own and intend to trade
• Represent your items honestly (condition, authenticity, photos)
• Honour agreed trades in good faith
• Treat other users respectfully in all communications
• Not use the Platform for any illegal, fraudulent, or harassing purpose

We may suspend or terminate accounts that breach these Terms, receive repeated user reports, or fail to honour agreed trades, at our sole discretion.

4. Safety of In-Person Exchanges

Swapito facilitates online listing and communication only. Any decision to meet another user in person, exchange items, or share personal details (including home address) is made entirely at your own discretion and risk.

We strongly recommend:

• Meeting in a public place (e.g. a shopping centre, library, or Woolworths/Kmart store) rather than a private residence
• Bringing another adult with you, especially when a child is involved in the exchange
• Verifying the other user's profile and any ratings/reviews before agreeing to meet
• Never sharing financial information, passwords, or sensitive personal data with other users

Swapito does not conduct police checks, identity verification, or background checks on users, and cannot guarantee the safety, identity, or intentions of any user.

5. No Liability for User Conduct or Trades

To the maximum extent permitted by law, Swapito, its owners, and operators:

• Are not liable for any loss, theft, damage, injury, fraud, or dispute arising from a trade, meetup, or interaction between users
• Are not liable for the authenticity, value, or condition of any item listed or exchanged
• Do not guarantee that any trade will be completed, honoured, or fair
• Are not responsible for the accuracy of user-generated content (listings, photos, descriptions, or messages)

Use of the Platform, and any resulting exchange of items, is entirely at your own risk.

6. Optional Visibility Features

Swapito offers optional free features, including Golden Boost (featured placement for a listing) and Swapito SOS (an urgency broadcast to nearby members). Use of these features:

• Increases visibility of your listing or request only
• Does not guarantee a successful trade, response, cash top-up, or any outcome
• Affects visibility only, and costs nothing
• Runs for 48 hours from activation and may be used again after that

7. Peer-to-Peer Cash Top-Ups

Some members choose to agree on a cash top-up alongside a swap, for example, when a rare item is exchanged and the parties agree the recipient will also pay the lister an amount reflecting what the item likely cost to obtain. Swapito may display a suggested fair-value guide (currently up to $30 AUD) to help members reach a reasonable agreement.

This guide is informational only. In relation to any cash top-up or payment arranged between members:

• Swapito is not a party to the arrangement, and does not process, hold, transmit, or take any commission from the payment
• Swapito is not a payment processor, escrow provider, or financial service, and no payment functionality is built into the Platform for this purpose
• Members are solely responsible for agreeing on, arranging, and completing any payment between themselves, by whatever method they choose (e.g. bank transfer, cash in person)
• The suggested guide amount is not a fixed or platform-enforced price, and Swapito does not verify, guarantee, or enforce that any agreed amount is paid, fair, or honoured
• Swapito is not liable for any loss, non-payment, dispute, fraud, or disagreement arising from a cash top-up arrangement between members

Members should treat any cash top-up with the same caution as arranging payment with a stranger. See Section 4 (Safety of In-Person Exchanges) for guidance.

8. Reporting & Moderation

If you experience a scam, dishonest trade, or unsafe interaction, please report it via our Support page. We may investigate and take action (including account suspension) but cannot guarantee resolution, recovery of items, or compensation for any loss.

9. Intellectual Property

"Ooshies" and other collectible names, characters, and brands referenced on the Platform are trademarks of their respective owners (e.g. Woolworths Group, Zuru, Disney, and others). Swapito is an independent, unofficial platform and is not affiliated with, endorsed by, or sponsored by Woolworths, BIG W, Zuru, Disney, or any other collectible brand referenced by users on the Platform.

10. Limitation of Liability

To the extent permitted by law, Swapito's total liability to you for any claim arising from your use of the Platform is limited to AUD $100, as the Platform is provided free of charge. This limitation does not extend to any cash top-up arranged between members, which Swapito is never a party to (see Section 7).

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
